The problem goes a little deeper because Dolphin messed up putting keys on the emulator. So they need to remove it to make legal again.

Remember when Nintendo tried to prevent Blockbuster from allowing people to rent videogames in the U.S because it was illegal in Japan?

Nintendo tried everything they could short of taking legal action, but Blockbuster still ultimately was able to collect the NES cartridges and allow people to rent them.

it should be noted that its now being reported that Nintendo most likely did not file a DMCA but rather Valve contacted Nintendo regarding Dolphin on Steam and Nintendo threw a fit about it
there's also reports regarding Wii encryption keys being present in the Dolphin emulator source code which while not 100% illegal is in a very iffy grey area

If any gaming company would fight nintendo it'd probably be valve, they also have a massive fanbase funding them till the cows come home as well as vested interest in game preservation. While I'd like to see it happen, it'd probably be like godzilla vs king kong situation, no matter who wins the landscape will be ruined. However I absolutely bet it's a scare tactic to see if they can bully a major competitor into keeping their monopoly.

I think people seem to misunderstand what’s going on here. The Dolphin team (should be) fully within their right to put Dolphin on Steam, as far as I know.

Unfortunately for them, they pushed code onto the Steam release that had decryption keys which I believe are included in the Wii’s BIOS, which would 100% fall under IP if that’s the case. That’s why other emulators such as PCSX2 ask you for a legally obtained BIOS file and will fail to function if you don’t provide it. Who knows why a Dolphin developer thought it’d be a good idea to go around that, and why it hasn’t been fixed at this point as it was mentioned on the GitHub repository in 2020, as seen in Modern Vintage Gamer’s video.
