absolutely, i had to up my medical records as far as evidence, in 2022 1 xray 1 mri /2023 1 xray 1 mri to show my condition got worse than 2022, whenever i get new records i send then to my lawyer, Stephanie keep us educated very well, there were things i didnt know but learned from her😊

One advice… if one has a specialist keep them… they are hard to come by and y may take months before you can find or get in to see one. That’s even when pcp’s send referral. I have a rhumatologist and have to drive 3 hours to see her I will keep her just because where I live it’s so rural not only that some of those rhumatologist don’t have the knowledge of some autoimmune diseases or specialize in that particular autoimmune that one may have. I also have a gastroenterologist luckily it’s a. 30 mile drive and my psychiatrist is local and my counselor is via zoom. I’m at recon as of October 2023 but all these other specialist I’ve had before my Denial. And had hard evidence. Only new doctors is my physchiatrist and counselor. With new diagnosis like osteoporosis and also physical therapy

Disability Determination Services (DDS) place far more weight on treating source evidence than a one-time exam. DDS will only schedule an exam if the treating source doesn’t have the objective evidence needed to make a decision. Applicants should always, always ask that their own doctor conduct the exam. When DDS asks (which is policy: always try the treating source first), doctors decline b/c SSA doesn’t pay very well, and/or they don't want to damage their relationship with the claimant. But, if the patient/claimant asks their doctor and s/he agrees, the claimant should call DDS and ask to have their doctor perform the exam.

Treating source opinions are given great weight in a determination if: 1. Their own records support the opinion and 2. They're specific about the claimant's limitations. It's not sufficient to say, "Jane is disabled."

The reconsideration stage is not a rubber stamped process. Claims get a "de novo" review - a new review - with a new analyst and a new medical consultant looking at the case and any new evidence with fresh eyes. Many denials are overturned on recon thanks to a different perspective on the evidence.

The initial allowance rate depends on the state, but it's well over 10%. A 10% allowance rate would draw close scrutiny from the federal Office of Disability Determinations and the Office of the Inspector General. They conduct regular audits of Disability Determination offices and of Administrative Law Judges. If any office or judge denies or allows far more than the average, they are investigated. A 10% allowance rate would suggest that only people who meet the listings are allowed, and you know that's not so.

I never know if this info is for SSDI, SSI or both. Is the process to obtain SSI the same as SSDI?
