What's the difference between a Hearing and Evidentiary Hearing? Do the Courts specifically say "Evidentiary Hearing"? Or just Hearing?

Unless it is clearly stated in the final settlement, whoever has primary custody can do alot without too many issues. My ex tried to switch schools for my daughter as well. I threatened legal action if she tried. The current statute in my state explains that the childs current school cant be changed without both parents agreeing. She then tried again during the final phase of the divorce and I held firm that my child will stay in her current school. The ex was denied the right to change school at any time. We both share legal and physical custody. 50/50 split. Some good advice I was given to me by my counselor; be ready to play hardball with the ex. They will not work with you. They will not help you. Dont let your guard down. Pick what you want and work towards that. Stay focused on your childs needs. It's for them anyway.

My ex has had it out to get our daughter in the grammar school that's in her zone in our little town, the two schools in question are literally in walking distance of each other. I agreed to swap schools this year because our daughter begged me so she could be with her best friend. It's like she thinks that she will have a leg up if our kid is enrolled in the school in her residential zone. Performance wise they're the same, so whatever, I just don't want to fight over something so trivial. Next year she'll be attending the one and only middle school and it'll be a non issue, to her.

Exactly what I am in. In a temp custody. Perm custody hearing date is set, very soon. Although registration for school is now to start in September. Father has temp prime. Father fails to respond to my questions re school. Father also terminated child from day care when he took our child 2 years ago. Child has been isolated in his apartment w the elder drunk grandmother. Father admits he is keeping child isolated. As the mother I am registering our child for school or we will loose the spot. 1- Since custody hearing is before school starts have you seen the judge favor my diligence in being the responsible parent all around? Father denys my visitation often and behavior patterns show his spite rather than the best interest of child etc 2- what other provisions can you suggest re school?
Thank you. You are helping p.s. my case has alot of moving parts re fraud, false allegations, manipulation also on my 4th attny since I've been hiring wing its taking me under false pretenses. Taking stand for perm custody I intend to turn this entire case around to show the father is clearly doing this out of his narc control. If I can get more leverage gaining authority over All the childs decisions then we have a child who has a strong chance not becoming the fathers character in life.

My husbands ex changed child’s school. Sent an email basically saying that she was doing it and he sent an email back that was saying she had already made the decision but despite another email the same day saying he didn’t agree after research of school. The judge didn’t even take that email into consideration only the one that said she had made the decision already. Can you do a video on requesting a new trial vs an appeal?

So if we filed a motion, received no response/opposition, submitted request for submission is it safe to say that it will be granted in regard to this school issue or is there a possibility that we might still have to go to court?

In my situation my daughter is not even 2 years old yet and my ex wants to send her to preschool. I expressed that I think it’s too young for school and that I did not agree and she did it anyways. Is there anything I can do? We have shared legal and physical but my ex is primary custodian.
