Three new criminal laws — Bharatiya Nyaya Sanhita 2023, Bharatiya Nagarik Suraksha Sanhita 2023, and Bharatiya Sakshya Adhiniyam 2023. These laws will replace the old British-era laws: the Indian Penal Code, the Code of Criminal Procedure, and the Indian Evidence Act.
After Independence, India's criminal justice system has faced many problems and hasn't worked as well as it should. Some of the main issues are poor investigation and prosecution, a huge number of pending criminal cases, slow court processes, delays in finishing cases, a low conviction rate, and many undertrial prisoners.
All these factors end up with denial of justice to the common people.
Now the purpose of introducing these new laws is to focus more on justice rather than just punishment. They aim to provide faster justice and improve the judicial and court management system. The goal is to make sure everyone has access to justice.
