A Cape Town family embroiled in a court battle to occupy their multi-million rand villa in Hout Bay says their rights as property owners have been violated. Emilia Vollmer and her 11 family members say they were recently forced out of their home by the court sheriff. They have spent R200 000 in legal fees to evict a tenant who refuses to vacate the property. Vollmer says the justice system is flawed and discriminates against rightful property owners.

Clearly the owner failed to follow due process, thus the success with a spoliation order. The reporting must be called into question, as it fails to properly contextualize the events. If due process is adhered to she will most definitely get the result. The law works, despite it being costly and time consuming. Pity she wasted the 200k it seems upon, defending her transgression upon his peaceful possesion, as opposed to applying it to obtain an ejectment order. Moreover, regrettable that she had not been advised when concluding the offer to purchase to insist upon vacant occupation on transfer. These elementary failings are now being exposed and reported upon as a basis for the assertion that the law failed her. Blatant sensationalism and questionable editorial integrity.

I am a pensioner and could easily make extra income for myself If I let out my outside fully furnished flat.I prefer to keep it empty for similar reasons as this.

People in SA really need to go into an reality check and realize that there is a actual world out there with people not as shallow thinking as some are in SA. Why would you even question her? As you can see she is an foreigner possibly in her country the covid redtrictions are lesser than in SA end she wants to move back in to her house? Obviously not considering the local laws in place, which totally justifies this mans position. Just an simple situation and South Africans mention race, Nationality etc get over yourselfs!!! What nationality is the owner?
What is her/their residence status in SA? What is their business/source of income/ SARS status? Why does she present her side of the story in this way, when she knows exactly what the law says and the court has ruled?
