Roadside Sobriety test are designed for failure. That is the #1 reason to refuse the test.

About 20 years ago I was stopped for having a tail light out. Cop asked me if I had anything to drink. I told him I had one beer about 4 hours ago--which was the truth. He asked me to get out of the car and do the tests. I complied. I performed horribly on the coordination exams as I was extremely nervous. He then asked if I wanted to do the breath test. I said yes as I new I was sober. I blew into the device, and then the cop said to me and I quote: "I have never seen anybody so sober do so poorly on the coordination part of this exam". I then said "I know I did badly. But I am more relaxed now, can I do it again?" He then said "no, I really don't have time for this, get your light fixed". And he sent me on my way.

If an Officer asks for a sobriety test, he already wants to arrest you for DUI and he is only looking for more evidence to arrest you. Don’t give it to him/her!

A sobriety test is a form of testimony and your right to not testify against yourself is constitutionally protected. Literally HUNDREDS of judges and cops caught drinking have refused.

Several years ago, I was pulled over by 3 officers (3 cars) around 2am. It was extremely cold, with temps (in the low/mid 20’s). I had not had a single drink yet I complied with doing several field sobriety tests - HGN, Walk-and-Turn, One-Leg-Stand, Finger-to-Nose, Alphabet, Breathalyzer. It seemed to be nearly 30 minutes of tests, in sub-freezing weather. It was ridiculous and I just “knew” they weren’t going to stop until I failed a test. My friend in the passenger seat was so sure of it, in fact, that he called a friend to come pick him up. The PO’s eventually gave up when I blew 0.00 on the field breathalyzer. When asked why I was pulled over, I was told my license plate illumination lights were out (they were). I believe most people are so damn fearful when they get pulled over, they just do what they are told versus thinking about their rights. Bottom line, “don’t drink and drive”.

That was an awesome video. Super clear and concise, completely reasonable. One other reason to refuse - it will never help you, only potentially hurt you.

I haven't had an alcoholic drink for the past 30 years, but at 72, my balance is not so good. Good information!!!! I was actually under the impression that, due to "implied consent, " failure to submit to a sobriety test was reason for arrest.

I'm 6'3", 300lbs. I have issues with my back, knees and ankle due to a car accident. I NEVER drive drunk. I promised my driver's ed instructor. Thank you for the video.

The major problem with all these tests is that the results are subjective and depend on an assessment by badly trained officers, officer's trying to meet targets or having a bad day!

One time they had me do 2 sobriety tests in 1 stop and I was 100% sober. I never knew that I wasn’t required to do so. Been learning so much in your videos.

Not to mention that many cops have a goal of making DUI arrests. The results of a field sobriety test are subjective( subject to the officers opinion).
The opinion of someone who is trying to find a reason to arrest you.

Thank you for your service! Awesome video. I'm comfortably sitting at home, neither drunk nor recently arrested nor pulled over, but this is great advice.

If I'm ever asked to do a field sobriety test, I will respond...my counsel has advised me not to participate in a field sobriety test because of my weight and physical condition. I am overweight and physically disabled anyway, so that should be acceptable.
