You might be wondering if you can change the doctor you're sent to for an independent medical exam (IME). Unfortunately, you can't pick the IME doctor yourself, and the insurance company can send you to the same one repeatedly, even if their conclusions aren’t favorable. I have been on workers compensation since January 2020. I have injuries to my right and left shoulders, my left hip and my back. I had surgery to my left shoulder, an L4, L5 fusion to my back. I saw a different IME Doctor on January 2, 2024. He recommended that I have surgery on my Right arm. I saw the same IME Doctor on July 9, 2024. This time he stated that I have reached MMI, I have no lost from my left or right arms and hip but I do have for my back. In both of his IME reports he “NEVER” viewed any of my MRI reports. Can MRI findings be used as evidence and considered a third party independent evaluation? Can this IME Doctor be reported? Furthermore, I am seeing two different orthopedics. One for the injuries to my shoulders, One for the injury to my left hip and one for the injury to my back. Each orthopedic specializes in a particular part of the body. The IME Doctor I have seen appears to be the Jack of all trades. Can I make an argument that this IME is not qualified?
