If you kill someone at sea, you aren't a pirate. You are a murderer. Piracy is a _specific crime._ Not a catch all.

Also. Fun fact: the jolly roger was only flown for a brief time before boarding a vessel. All other time, a flag from some country was flown.
The jolly roger was a warning. The warning was: "if you don't resist we won't kill you." And it worked pretty well. Why? Because pirates weren't the only ones taking other peoples loot.

If I big French ship happened across a smaller Portuguese ship on its way back to Europe, the French ship would absolutely loot the boat and steal all the goodies. Then they'd kill the crew and sink the boat. They could NOT leave the Portuguese crew alive because it would probably start a war.

So if you were about to get looted, you wanted it to be from pirates, because they would leave you alive of you didn't fight back. You didn't want to run into a bigger shop from another country. That was a death sentence.
