Winning Back Pain Social Security Disability in 2023 - NEW VIDEO!

I'll admit, Social Security makes it quite difficult to win disability benefits for back pain.
Back pain issues are the NUMBER ONE reason people file for disability so SSA keeps tightening the requirements for approval.

Fortunately, you can still win but you have to have the right evidence.

Almost without exception, you will need objective radiographic evidence to win a spine injury disability case. MRI or CT tests will usually reveal the nature and severity of your back injury.

Generally speaking your MRI needs to show some sort of neurological problem. Terms like "nerve root impingement," or "stenosis causing spinal cord compression" or “herniated disc” indicate a problem that would be consistent with radiating nerve pain into your legs, numbness, loss of sensation and weakness.

You may also see medical terms like "degenerative disc disease" or "spondylosis" or "arthropathy" that sound serious but often are just medical terms for arthritis that develops in most people as they age.

Similarly a disc bulge sounds severe but many people live and work without limitations even with disc bulges.

Disability judges draw a very clear distinction between back pain cases that can be managed with rest, physical therapy and muscle relaxants, as opposed to those in which surgery or long term narcotic pain management is the recommended treatment.

Disability attorneys are not doctors but we can usually determine if the evidence in your case meets the profile that will likely result in an approval. If we can help you better understand what the evidence in your medical file means in a disability context please do not hesitate to contact us.

I have spondylosis and spinal stenosis with neuropathy. 4 bulged discs, 2 cysts and 2 annular fissures and arthritis in the spine. I’ve been denied 5 years! Now I finally have a hearing coming up. My life has been hell.

Thank you again Jonathon Ginsberg and your entire team for helping me win my case. If you 'think' you might be disabled to the point you can't work, consider calling Jonathon, regardless of your location. He has many videos here and on his website. He may be able to help you like he helped me. I always took notes with the videos. Mr. Ginsberg is in the Atlanta area, I'm in Indiana. Best decision that I made last year.

My back has been getting significantly worse lately. I have heard of many people who went to the doctor and the doctor refused to do any tests, because a lot of people are starting to say that back pain doesn't have an actual cause and it is all in people's heads! The people who say that are probably lying! Thank you for this video. I will tell my doctor about my worsening back pain, and hopefully he will do some scans. Otherwise, I will try to find one of those inexpensive MRI clinics you mentioned. I don't have a lot of money but I will do what I can because health is the most important thing.

This is me: spinal stenosis, herniated disk, limited feeling and muscle weakness in the left lower side. Leg buttocks, unmentionables, had a spinal fusion L4 L5 a year ago, the pain is just enough to make it hard to sleep. Frequently 4-6 times a night wake up. Difficulty with LDS surgery did not bring back the feeling or strength. Stand 20 mins max, frequent naps still using my walker every day, best relief is reclining, but within 30 mins the sciatica starts hurting on the right side. 🙄 Bus driver 16 years until my disc herniated, can not climb up the bus steps now, nor legally pass a DOT physical. Oh & 48 years living with fibromyalgia 🙏

Everything you mentioned at the beginning of this video I suffer from. I have so many of these issues if not all with my spine that you mentioned. My legs shut off from the nerve problems, the pain is 24/7. Stenosis, multiple disc issues. I can't remember when I actually had a real night of sleep. I cannot find a position that I can get relief from the pain. If I sit for any period of time it feels like my legs turn to stone when I get out of the chair and try to walk. My walking ability has diminished to 10% and I am being generous with the 10%. I lost count how many times I have fallen due to my legs shutting off and needed physical therapy for the spinal and extremity injuries from impact. You basically told my exact story. I have a previous MRI report from 2019/2020 and the imaging dvd but I am going to get an up to date MRI just to have the most current information for my case. September 6th is my appointment with SSA to get the ball rolling. This will not be my first time filing. The pandemic created many problems with medical records availability and at the last minute before my hearing my lawyer bailed out on me and left me in a horrible mental state. I have also been receiving treatment for mental health issues since November 2022. I am looking for a lawyer. Your video gave me hope that I can be successful this time around with better preparation.

I am in my waiting period to appear before a judge. I have an extensive spine history. I Have mild spina bifida but at 18 yrs old i had surgery to release a tethered cord. This is where my cord had a fatty tail extending from the end of my cord and connected to the spinal canal wall. I have dealt with severe back pain all my life. I went to my spine surgeon for the first time in 2014. MRI showed Spondylolisthesis and other things. He told me to wait and have surgery when i could not stand it any longer. With each passing year my pain and issues got worse. Severe right buttock and leg pain with numbness, tingling, and weakness. I started stumbling frequently bc my toe would hit when i would try to pick my right leg up to walk. In 2020 i just could not stand it any longer. I threw my back out 3 different times doing nothing. Each time was worse than the last. I literally could not walk, had to pulled out of bed. My husband had to wipe me bc i couldnt. After the 3rd time i went back to the same spine surgeon in dec of 2020. He did a new MRI and I had an L5-S1 fusion at the end of march 2021. I had about 75% relief and went back to work mid May to see how i would do. Initially I was ok but at about 3 months after my surgery, i started have new back pain and it was running around into my groin, between my legs, and down the front of my thigh. I had to go on Fmla on Sept 29th 2021. I was terminated at work in Feb 2022 bc i was not able to return. New MRI and it showed L3-4 had adjacent segment disorder. So in April of 2022, 1 yr from my 1st back surgery, i had a revision to a 3 level fusion, from L3-S1. I was diagnosed with failed back syndrome. It helped the pain in my groin and thigh. But i still have very severe back pain. My right leg is still very weak and it will be like that from now on. It is heavy and fuzzy feeling. Around January of 2023 i started having new pain. Lower in my spine almost sacrum area. It ran between my legs and down my leg again. Only difference was that every step i made it would shoot up my leg to my back. I had to have my husband help me or i had to use my walker around the house again. That way i could walk without putting pressure on my leg. I had several close calls falling. My pain management Dr did an injection into my SI joint first of march 2023. It helped. So now i have also been diagnosed with SI joint disorder. During all of this i started having right arm hand and finger numbness and tingling. For maybe the last 3 or 4 yrs i would have what i thought was recurrent "cricks" in my neck. Well, MRI on my neck showed almost complete collapse of C5-6 and partial C6-7 with radiculopathy and nerve root compression. In April of 2023 i had a C5-6 cervical fusion. He decided not to do C6-7 bc he didnt want to restrict my neck movement anymore than necessary. He said C6-7 may auto fuse. It took care of about 75% of the numbess and tingling. I still have some. My arm is extremely weak bc i already had less arm function bc of Parsonage-Turner syndrome that i had in 2015. I still have neck pain that runs down the back of my neck and gives me headaches. I am unable to sit for more than 20-30 mins and I have to change position. The only comfortable position with the least amount of pain in my back is reclining. I can not sleep in the bed. I have to sleep in the recliner.

As if my spine situation with current severe pain and leg weakness wasnt enough, i have been diagnosed with Lupus. My rheumatologist said i have inflammatory arthritis caused bu the lupus. My hands and feet swell almost every day, to where my feet are painful to touch on the tops. The joints of my hands hurt frequently and ny fingersbare swollen and painful almost every day when i wake up. She has had to switch my medicine a couple times. Im still not controlled. And you kniw autoimmune comes with other autoimmune. I have sjogrens, fibromyalgia. I also have recurrent major depressive disorder. It is from everything I am going through with my health and finances, not being able to provide for my kids like I need to. My husband is having to work 2 jobs.

I am 44 and have had my initial denial, reconsideration denial, and now waiting to go before a judge. My lawyer says she is almost confident that i will be approved. Do you have an opinion on what i have said?

I am in the reconsideration process now and fortunately my doctor is very supportive. On top of the RFC reports he has filled out and all of my recent objective evidence, MRI, X-ray and nerve conduction tests that the SSA has been sent, he just wrote a letter for me yesterday stating that i meet TWO of their musculoskeletal blue book listings without a doubt and can not work for 12 months or more and that in his opinion i am disabled. He mentioned me having everything that both listings speak of and that in my case it is all severe. Will this letter finally be enough to save me from another denial and a minimum of another year waiting to go before a judge?

Shoot. I was diagnosed with Spodilolthisis (3-4) a year ago by the nurse practitioner (i've never seen the Doctor he's never available) . She told me I don't qualify for disability because, I need to walk more. I HAVE A DESK JOB!. says, I need to loss 100lbs to even consider surgery. Even then they strongly advise against it. I have back pain, pain when sitting, standing, driving, and my legs get heavy and stop working. IT HURTS!

I have back pain ass pain hip pain leg pain neck pain headaches vertigo all the time and so far I can't win at 57 years old. The more I move and the more I work the higher the pain goes up and it keeps getting worse with age. Absolutely miserable 90% of the time. Nothing helps except to take it easy

I wish you were my representative but my hearing is on thurs the 19th. MRI: C6-C7 disc extrusion. Severe spinal canal stenosis. Severe spinal cord deformity. ACDF surgery followed by 2nd anterior cervical surgery, C6 Corpectomy w/ C5-C7 fusion.

Lumbar MRI: L5-S1 extrusion displacing L S1 nerve root with nerve root thickening and edema. 4x epidural injections.

Mental Health issues requiring a psychiatrist, 12 or so therapy sessions, 200mg sertraline / day, 900 mg gabapentin per day, 50mg Quetiapine per day. I don’t feel very well prepared for the hearing after 30 months

I've been out of work for 28 months now. I just got my rejection notice for SSD at the "reconsideration" phase. I am filing for the hearing with the judge next, but I'm very nervous.

I have severe spinal canal stenosis in my cervical spine in which I just had a 2 level ACDF between C4-C5 and C5-C6 and a C5 corpectomy but as my surgeon said the operation may not help any of my symptoms and was being done mostly to keep it from getting worse, I had the operation on Dec. 29th and as of today I have seen no improvement and dont expect any I go to a Medical review on the 8th of march then the psych. review on the 17th but Im not holding my breath an figure I'll get refused even though I have trouble even walking anymore.
