Why You Should Never Lose a Back Pain Disability Case if You are Age 55 or Older

If you are age 55 or older and are pursuing #socialsecuritydisability due to #backpain your odds of winning are very high.

Social Security's #gridrules are designed to help #disability applicants over age 55 win. In this #shorts video I explain why.

Under Grid Rule 202.06, for example, you are very likely to be found "disabled" under SSA's rules even if you can lift up to 20 lbs. and stand and walk for 6 hours a day.

You will need medical evidence of a diagnosed back problem - such as an MRI that show a disc herniation or severe disc bulge and you do need medical records detailing ongoing treatment.

Grid Rule 202.06 is very unusual in that it actually gives disability claimants an advantage in the very dysfunctional Social Security disability process. I would not be surprised to see SSA change this rule in the future but for now, it exists and it can greatly improve your chances at a win.

Obviously every applicant's case will be decided on its own merits but if you have stopped or are about to stop work due to severe back pain and you are age 55 or older, please look at the grid rules.

I'm 58 years old and currently at step 4 of the process. I worked 24 years with at&t until I had a on a job jury to my back. Hoping you are right about these grid rules and I get approval soon.

It is what it is! We don't ask to become disabled! I would rather feel like I was 20 again! We deteriorate as we get older, especially if you worked hard ass manual labor jobs all your life! If I got a job working at Social Security, maybe I wouldn't have the problems that I am having now!!!!

In these grid rules cases a good attorney will often prepare a pre hearing brief laying out the theory of disability according to the rules and make it easy for the judge to make a determination.

You can be a step 4 denial if your past work is light or sedentary according to the DOT. This assumes you have a light RFC because of your back. SSA can say you can do your past work and deny you at step 4 of sequential process.

I did, after about eight years they gave SSI then took it after my wife got on disability for terminal cancer and stage five kidney failure. They said we were aloud 1385.00 a month she got 1164.00 they wouldn't even give the 220.00 difference back. "They" said we didn't need it.

I am 62, 63 in February. I'm a hairdresser who has continued working but at a very limited level due to upper back pain. Last January I learned I have severe osteoporosis, really severe, and I've now confirmed multiple fractures including two at T 6 and 7. Pretty sure that's why my back hurts when I work (when I do anything that involves holding my arms out in front of me.) It may also be how I got the fractures. I'm at work now, got lucky today, am getting a break, which helps; often I get no breaks at all, and by the end of a four hour shift, I'm nearly in tears from the pain. I've only been doing this job for a year, was freelance before this but wasn't making enough money, couldn't seem to get anyone interested in hiring me for equivalent pay. It's a bind, the paycheck really helps but I dread every day I go in. Now that I know I have fractures (that of course don't heal normally in the spine--I'm developing a hump, ) I'm wondering if it qualifies as a disability.

im 58 have severe stenosis, nerve root impingement, arthrosis, ddd, plus ptsd, type 2 diabetes with neuropathy and radiculopathy, i applied 18 months ago, but dont trust not having a lawyer so i hired a law firm thats representing my case

VE again. For years I have seen the DDB automatically say that an individual can do Medium work. So often it is knocked down to Light or Sedentary at the hearing level.

I'm 37 years old and really hurt my lower back in my early 20s. I've lifted weights for years, hard manual labor jobs such as concrete, Demolition, and worked on the oil rig in Texas. I've herniated multiple times and this last time had an mri and they recommend epidural shots. It seems like everytime I injury my back it gets worse. I can only get manual labor jobs because of my criminal past. I know I'm young but would I even have a shot at getting disability? I'm tired of injuring my back, excruciating pain down my leg where I have to quit a job because I can't move for months. Thanks for the vid.

Is meaning after 3 years of fighting for it, i could finance get aproved?

I have two herniated discs in my lower back and I'm 54 turning 55 August 9 I visited the social security doctor June 12 I'm just waiting to see if I get approved in Texas hopefully I find out soon

Husband is 59 with back issues, prominant arthritis is both feet, carpal tunnel in both hands, just went through surgery for stomach cancer and now has prostate cancer. He just got to step 4 of a non medical evaluation to see if he still qualifies. Is this a good sign he will be approved ?

What about neck pain?

What if someone is over 55, and has all of these?

-Cervical stenosis
-Cervical Spondylosis
-Radiculopathy
-Myelopathy
-CCI
-Eagles Syndrome
-and more

I feel like these issues are equal to, or worse than thoracic or lumbar back pain.

I'm scheduled for another MRI Open Machine... I Am not 55 but The Order is for M54 16 Lumbar Radiculopathy and M54 42 Lumbago with Sciatica Left Side

This Merve Root Disorder has progressed to giving me Guillain-Barre like symptoms!!
