Thank you, this is an excellent subject matter to touch on. The OC is supposed to send the consumer a copy of the 1099c and sometime they don't. Many consumers do not know that a charge off is sent to the IRS by the OC and the status of the charged off debt changes to income for the consumer via the 1099c. Uneducated consumers need to be weary of double dipping from debt collectors. A few years ago I sued a debt collector and we settled prior to discovery. However, during our negotiations for damages they had the audacity to try and get me to sign a W9, and that is when I refused to agree to a W9 and used the 1974 Privacy Act. secondly, damages collected on a disputed debt is not a taxable event. Lastly I explained that how can they possibly get tax credit on a debt that the OC already filed a 1099c for. The point is, DC's buy evidence of debt and create contrived account numbers and if you sue and defeat them they demand you sign a W9 so they can write off their bad behavior.

The charge off has to have already occurred, correct? I have a discover card and I’ve tried to negotiate with Discover regarding it but they won’t budge and just recently told me it will be charged off on 11/30/2023

Thank you for everything. I just settled with Wells Fargo last month and they're telling me that the 1099 wouldn't be filed until next year is that correct?
