A family from California was threatened with jail time and then booted off an oversold Delta airlines flight last week for refusing to give up a seat they paid for, according to a report. A female employee can be heard telling the father in the video, “Then that’s going to be a federal offense and you and your wife will be in jail and your kids.” The flight attendant on the full flight cited FAA rules and regulations on the red eye from Maui to Los Angeles but further inspection indicates the family was in the right.

As a parent who pays for my kid's airplane seat, I 100% understand the dad. He should sue the airlines for threats and harassment.

The fact they didn't offer the overbooked passenger compensation and instead resorted to threatening a father with jail time is insane. 😊

Unbelievable. He paid for the ticket and they tried to toss him off. Ridiculous. Get a lawyer and sue.

They’re suppose to pay passangers to get off the flight when it’s overbooked. I was on a delta flight they paid 3 people 2k to get off. Saying his kids are going to go to foster care is DISGUSTING!!

"The father believes the reason his son's seat was bumped was that the flight was overbooked." The father has a point.

My wife and I were flying to the east coast with our infant daughter who was in a baby basket type car seat. A stewardess informed us that the baby basket wasn't rated for aircraft and that we would have to disembark, get a different seat for our baby and take a latter flight. I showed her the tag that said the basket was rated for aircraft use. She wasn't happy and yes, the flight was over booked.

If you sell the same thing, to two different people, ANYWHERE else in the world, that is FRAUD.
But SOMEHOW, it's perfectly legal for airlines to do it, and threaten people who disagree with arrest????

The flight attendant should be the one arrested and sent to jail for harrassing the family.
Very inconsiderate and immoral if you ask me. They have no repect for Family especially young children.
Very disappointing!

Regardless of whether the father is right or wrong (but as an airline pilot, I know he is right), it is just bad business to argue with a perfectly calm father who was sticking up for his family, his 'paid-for' seat, and what is logical. Just bad business.... and on top of that, DELTA, you are wrong, your flight attendant needs to back off and learn the FAA rules.

As a pilot, there has always been a running joke that if your life ever goes to heck, you could always still get a job at Delta.

The man paid for the seat. It does not matter if the passenger is 2 or 20, a paid seat is a PAID seat. The man does have a right to be angry at this. HE PAID FOR THE SEAT! Now, if it was given for free, we may be in a customer service nightmare, but he paid for it.

People need to realize this occurred in May of 2017 and that 2 yr old is now 9. Delta apologized reimbursed the flight and costs and gave additional compensation. The flight attendants were wrong and probably required to take additional education because it really made Delta look terrible.

Threatening with jail and kidnapping! Employees and employers need to held accountable, scary for that family.

Threatening someone with jail should not be this easy or taken this lightly. That lady deserves being fired for this.

The lady that threatened him with a bogus law should go to jail.

She isn't a person of the law and cannot throw around comments like that. She should be fired immediately

The Airline should be answering this in court while being sued, because they took a prior notified payment for that particular aged kid and then afterwards they harassed the customers ...

As a former flight attendant who was a lobbyist for the flight attendant's union and specifically lobbied for the safety of children, those flight attendants are WRONG about insisting that the 2 yr old not be in a seat. They don't need to be flight attendants if they are going to go on a power trip and threaten parents with jail.

The attendant should be jailed for blackmailing people...

This is outrageous. He paid for his child's ticket. Then he was threatened with jail and his kids taken off of him?? A paying customer.
