The major problem with this analysis is the chain of custody associated with how Trump came into possession of the docs he took to Florida and the fact that a setting POTUS is the only Constitutional authority that can Classify any federal executive branch docs. The SCOTUS will likely have to weigh in on Classification as well as ownership of the docs. This all boils down to, 'can the Congressional branch make law that allows the unelected federal bureaucracy (in this case the DoJ and FBI) to subjugate, control a setting POTUS, and effectively hijack the executive branch?'

How do you inadvertently take classified documents?

Surely there are security protocols in place if there security protocols does that mean that they were smuggled out / stolen. I seriously dont understand how someone can accidentally take classified materials.

If you're willing to bring them back, then it would be a much lesser crime. But it wouldn't necessarily be completely thrown out of the window that it has a potential to be a crime. Because it's the same thing. It's the same exact thing, but milder.
