Usually, in a public execution, if the hope broke, you are free, because would be considered "divine intervention". Of course, it would depend also on the time period and circumstances and the authority present to declare so.

What I love about this scene is that later on in the game you get to visit this exact location

The original path of exile character screen also had a similar setup. A ship full of exiles in the middle of a storm, the exiles will talk about how they got exiled when you click on them and whichever one you choose survives the shipwreck.

Very good way to establish that you're not going to encounter the other possible player character choices later in the game. They're all dead. Love that
