I have been a Defense Attorney for 27 years. For the past ten years I have worked in the various stages of post-conviction proceedings in death penalty cases. My advice is pay attention to this guy. Everything he says in this video is legally correct, no matter where you live. If something varies from state to state, he tells you so. The only thing I would add is this: If it ever appears from the context of the situation or from the questions they ask that police suspect you of something, do not try to convince them it's not you. They will twist your words and use them against you. No matter what they tell you, reduce your vocubulary to one word: "Lawyer!"

You left off the most important tip of all. If police show up at your door you do NOT have to talk to them. You don't have to answer your door. (Unless they announce they are there to serve a warrant). Then, you can demand to see the warrant through a closed window. After being wrongfully arrested 2 times in my own home I will no longer answer the door if police knock on it.

Thanks Tom. Summary:

1. Don't give consent to search. Consent can be specific words or even non-verbal. Speak clearly that you do not consent to a search. Make sure everyone in the house knows.

2. Don't have illegal stuff in plain sight.

3. Probable cause can be a warrant (written court order), or exigent circumstance (emergency threat to life or property, fleeing suspect, destruction of evidence)

4. Police are allowed to lie and trained how to do it well. Do not talk with them.

As a kid of the 60s, we had cops for neighbors. I was taught to respect them, never to question their motives or actions. My teenage grandson has been taught way different! Minors cannot consent to allow them to enter a dwelling, we've impressed that fact on him. He knows not to open the door for them. Not because we're doing anything illegal, just to protect us from their lies. The drug war has provided low hanging fruit & unsurprisingly, has become the focus of their activities. Murder solve rates fell after criminalization of cannabis & is, overall, deplorable. Gotta chase that sweet Federal money & look towards asset forfeiture! Policing has changed & not for the better imo.

Tom excellent video. I am retired LEO. I had a partner who use to say this, and he was right. "Whether you are a victim, witness or suspect. No good can ever come from talking to the Police!" Food for thought. Keep up the good work.

I’d love to get a reading on exigent circumstances bootstrapped by “anonymous tips, ” not necessarily limited to SWATting. I don’t put it beyond law enforcement to create their own exigent circumstances this way.

As a 66 yo woman who has never been in trouble with the law, thank you. Sadly I have little trust in police. It started when i was a pretty young woman. A policeman driving next to me on the street asked me my name. I ignored him. This angered him and he told me he could pull me over and get all the information he wanted, even if i was a virgin. All while driving down the street, i was so afraid but still ignored him. Thankfully it was an empty threat. So I appreciate you providing this information.

One time a cop showed up at my door asking about someone I let stay at my house for a few weeks. This person was down on their luck and needed a little help. About a month after they left/moved out the police showed up looking for them. They asked to search my house for a stolen item in relation to the person I let stay at my house. I knew 100% of their items left with them. I said NO you can't search my home. He pushed back with threats about if they find reason to believe its their they will get a warrant blah blah. I stood my ground and repeated NO. He left after telling me again about possible consequences. I felt guilty even though I had done nothing wrong. Its hard to tell them no but you must. Never EVER let a cop into your home without a warrant.

Great video Tom. I would also add if someone grants the officer consent to enter their home, that consent can be withdrawn at any time. Unless the officer (while in the house under consent) sees contraband, if the homeowner tells the officer I am no longer consenting to you being in my house, the officer(s) MUST leave. This ability to withdraw consent can be a VERY powerful tool to recover rights that are waived. Courts have said law enforcement can infer that consent to search a home was granted if the property controller was holding open the door, but when revoking consent it must be direct and unambiguous for the best way to survive a court challenge. A good statement to make is "I am now withdrawing my consent to search, and unless you have a search warrant, you are to exit my house immediately."

I had the ATF call me once and come to my door once. In each instance it was about guns I had bought new and sold legally to someone else. Eventually the guns showed up at crime scenes. Since I am in Illinois I was able to dig out the bill of sale (10 year record requirement). The two ATF guys who came to my door expected me to give them a hard time and I started out that way since I had no idea who they were. I stepped outside and talked and left them on the stoop while I tried to find the paperwork on said gun. It was fine, I was happy to cooperate but I do agree you really need to be careful. Tell you what, always have a lockable screen door in front your main door. Then you have “protection” from them just opening up a door.
