I was arrested denied the test they never took nothing from me. I kept my license as well not sure what to do my court comes Tuesday. I have a lawyer and took am online class. They have no evidence of me drunk besides probably my behavior.

Lord, if he made it home, he was home free! They cannot prove he drove drunk nor even that it was him driving his car. He shouldn't answer the door.. and if they get a warrant to come in, he could just pour out some beer or vodka, and put it on the table, say he started drinking the moment he got home. Done. That would be a piece of cake, I believe, for a good lawyer.

This is the first DUI lawyer I've ever heard who didn't stress the importance of ALWAYS refusing Field Sobriety Tests. He makes it sound like he WANTS you to do the FST'S. No buéno.

I had no alcohol in my system but was on a legal prescription had a 1200 dollar accident and he sad he smelled alcohol so I had to give blood I was not high just had my prescription in my blood and now I get charged with drug dui I will never take any prescription drug or any drug ever again this was bs because the lady I hit loves to call the cops I ran her driving record she got 3 speeding tickets one of them was 3 weeks before our accident my advice to you all is be careful when taking a prescription like don’t drive but the sad thing is most cops are on the same prescriptions that they put us in jail for and there out there in high speed traffic chasing people and they wreck all the time but no blood test for them

Cook County IL, Fell asleep at at red light. Woke up by the fire dept. PD unable to wake me. Once awoken, Stated I am a diabetic and need an ambulance. PD offered fields, I, refused. Under arrest taken to the hospital. Refused blood and urine at the hospital. Released from ER, taken to PD FOR BREATH. Refused. What are my chances at trial?

You're actually an attorney?? I'm surprised. I'm not an attorney, or have ever been stopped or arrested for a DUI, and I know more about this than you do. why don't you give true legal facts.
1. False. You said your breathalyzer has to be .08 or higher in most states to be arrested for DUI. People should know that you can be also be arrested for DUI even if it's lower than the allowed. 2. False. People should always refused the voluntary field sobriety test always, including the on-site breathalyzer which is also voluntary, but in most states can pose a fine only that is not a criminal or arrestable fine. 3. True. However if your handcuffed and taken to the police station and they ask you for either blood or breathalyzer, you should do it, however if you don't, you can lose your license up to a year, depending on the state you live in. And if you don't agree then in most staes they can get a judge to issue a bench warrant to forcibly take your blood. 4. Never ever, under any circumstances, answer any questions. It's none of the police officers business to know where you are coming from, or where you're going to, or how much you had to drink, or if you were even drinking. Simply say I don't answer questions. And the police officer ask for your driver's license proof of insurance and registration and it's a traffic stop you need to give that to them. If they ask you to get out of the car you should comply. Other than say I don't answer questions. 5. Remember that police officers legally can lie to you so they can try to get information from you. 6. And lastly, a good attorney will go through the police officers training and ask in open court what are the elements of the DUI senarios on DUI stops, if they waited long enough time prior to giving you a breathalyzer for observation, and if pertinent information was given timely like the witness list prior to trial, if it goes that far, or even if they had probable cause to pull you over, etc.
