It is shocking a good Samaritan like Penny was even charged. This certainly is a window into how depraved and uncaring New York City has become. Very distressing! (Decent folk are becoming an endangered species.)

Daniel didn't mean to kill that man. He was stopping a threat. The courts should take it easy on him. People calling him a murderer are just as nuts as the dude on the train. Maybe that's why they relate to him so much. They are loonies too.

That was intentional. Penny didnt stop once he got him down and controlled. He willfully continued to choke him, thats manslaughter. He should be charged

Ok, let's use common sense and not emotions. Emotional disturbed people on the train all the time and some are threatening. The threatening people need to be dealt with. Penny stepped in and stopped the situation from escalating. So far, so good, but the applications of a choke hold beyond consciences, and going limp by a trained military person was beyond what was needed. After Neely is going limp, Penny should have checked if he was breathing since he knew he was not moving and was not intending to commit murder. Mistakes were made he by appearances and did not intend to murder the victim Neely. Punishment, yes, no medal because he didn't use his training correctly to protect everyone even Neely who was having a mental episode which we all have had episodes at one time or another or course not not in the situation (well maybe some of us). So the intent to kill doesn't make sense, but to say he his innocent doesn't make sense either. In life, we need to use our heads, not emotions, especially not someone trained. Boxers and MMA fighters are lethal weapons and can go around knocking out random people without consequences. Penny needs consequences but not intent to murder. We need to unite under common sense instead of emotions, racial bias, and think as a human being, and what if it was your son either of them and how they acted responsibly or not.
