He wasn't holding a prop gun. He was holding a gun gun. And he pointed it at her after he allowed target practice on set with live rounds earlier that week. He is both the producer and the guy holding the gun. He is totally responsible.

This is a stretch in the extreme. He did not know that the firearm in question had live rounds in it. He was handed the firearm by the site armorer whose SOLE JOB it was to inspect the firearms to make sure that they were not loaded with live ammunition.
