Citizens Arrest for Indictable Offences | BlackBeltBarrister

This is a brief overview of when you can make a citizens arrest under section 24 Police and Criminal Evidence Act 1984 (PACE). This is different from a police arrest and has strict limitations. There are also risks associated with it that you should bear in mind before deciding to take action. A citizens arrest can only be made for an indictable offence that is in progress or that you reasonably believe someone is committing.

You may only use reasonable force and must take the person to a Magistrate or police officer to make the arrest valid.

Huge thanks to Marcos Tabasso for the knife!:

9 years in security have taught me many useful lessons.
1. The coppers already know the local repeat offenders, cctv and quality mobile phone footage is enough to identify most people.
2. Unless someone is armed the police aren't likely to rush to your assistance, holding someone until they arrive is very unwise.
3. Most career scumbags are likely armed, do not engage unless they present a physical threat.
4. Most people will take the path of least resistance and just leave, they may need to be convinced that's the easiest route but you should always let them go.
5. If I'm not getting paid i don't get involved, I'm not insured out of work.
More people means more chance of escalation.
6. If you are involved make sure you aren't blocking their route of escape.

Do not underestimate the level of violence you are likely to receive from trying to detain a burglar, shop lifter, car thief or anyone knowingly committing a crime!!

"Don't just go out arresting people on a whim."
Damnit, another one of my hobbies turns out to be illegal.

Have you ever heard of Crimebodge? He has raised 6 private prosecutions against rogue and violent police officers. I owe a LOT of my law knowledge to him and a LOT to you so i wanted to say thanks as well. My main interest in law is to be able to articulate realtime responses to the Police if they act unlawfully to me. Thanks to you and Crimebodge I am fully armed. Perhaps you could watch some of his videos and consider where your efforts could compliment each other ?

This is very interesting. I have two citizens arrests to my name, one being a shoplifter, and one a person riding a stolen bicycle. The latter gave me some worrying moments, as I might have to prove who legitimately owned the bicycle. Fortunately when the police turned up, the man lied his way into a corner before that became a problem. My dad has two to his name. One was a drunk driver who drove into the railings outside his house, and the other was a kid who he caught kicking over a neighbors wall. I had assumed that me and my dad were on fairly safe ground in those cases!

This reminds me of an hilarious article written by A.P. Herbert in the era when a citizen's arrest was permitted if the offence being committed was a felony but was not permitted when it was a misdemeanour. His suggestion was that you enquire of the perpetrator of the offence as to which category his act fell before attempting the arrest as they were more likely to have this information that the law-abiding citizen.

I find your videos very informative and although I am a quiete kind of person kind of person . Sometimes it is a good idea to possibly learn something to keep yourself out of trouble . I recommended your video of the five year old riding their bicycle on the road when I was out and talking with someone about bike riding
