APPLICATION UNDER ORDER 7 RULE 11 OF THE CODE OF CIVIL PROCEDURE 1908 FOR SETTING ASIDE PLAINT/CIVIL SUIT OF THE PLAINTIFF.

RESPECTFULLY SHOWTH,
1. That the above noted case is pending before this Hon’ble court and is fixed for today i.e 06.01.2023.
2. That the Plaintiff has filed the present civil suit for permanent injunction against the defendants.
3. That the plaintiff has no locus standi to file the present case.
4. That the plaintiff was not in possession of the land nor he has any concern with the same, therefore civil suit in the present form is not legally maintainable.
5. That the civil suit is time barred and same is liable to be dismissed.
6. That the sale deed is liable to be set aside being null and void as no sale consideration has been paid to the answering defendant. Thus, the civil suit is liable to be dismissed on that ground.
7. That the present petition is liable to be rejected under Order VII Rule 11 of the Code of Civil Procedure, 1908 as the plaint/civil suit miserably fails to disclose any cause of action.
8. That the plaint/civil suit is liable to be dismissed at the threshold as the averments made in the plaint/civil suit are vague and without any supporting material.
9. Thus, there is no cause of action which could maintain the present plaint/civil suit. There is no triable issue.
Hence, it is clear that the present plaint/civil suit fails to disclose any cause of action whatsoever and is liable to be rejected under Order VII Rule ll of the Code of Civil Procedure, 1908.

IN THE PREMISES STATED HEREIN ABOVE THE DEFENDANT MOST RESPECTFULLY PRAYS THAT THIS HON'BLE COURT BE PLEASED TO:
a) Pass an order rejecting the Plaint/Civil Suit under Order VII Rule 11 of CPC with cost;
b) Pass any other order/direction in that behalf, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case in the interest of justice.

आदेश 7, सिविल प्रक्रिया संहिता (सीपीसी) के नियम 11 (जिसे अक्सर आदेश VII, नियम 11 के रूप में लिखा जाता है) को 'वादों की अस्वीकृति पर कानून' कहा जाता है। दूसरे शब्दों में, यह एक नियम है जो वादी द्वारा दायर किए गए वाद की धारणीयता पर प्रश्नचिह्न लगाता है ।

सिविल प्रक्रिया संहिता का आदेश 7 नियम 11 क्या है?
इसलिए ये CPC आदेश 7 नियम 11 के प्रावधान के तहत आता है. जिसमें कहा गया है कि जहां वादपत्र में दिया गया कोई बयान किसी कानून द्वारा वर्जित प्रतीत होता है, उसे अदालत अस्वीकार करेगी. जबकि हिन्दू पक्षकारों का कहना है कि वहां 15 अगस्त 1947 से पहले और बाद तक लगातार देवी श्रृंगार गौरी की पूजा अर्चना होती रही है.

धारा 711 क्या है?
सुप्रीम कोर्ट ने कहा है कि आदेश VII नियम 11 सीपीसी के तहत वाद पत्र की अस्वीकृति के लिए एक आवेदन पर विचार करते समय, न्यायालय को पूरे वाद अभिकथन के माध्यम से जाना होगा और वह केवल कुछ पंक्तियों/ अंश को पढ़कर और वाद के अन्य प्रासंगिक भागों की अनदेखी करके वाद पत्र को अस्वीकार नहीं कर सकता है।

When can order 7 Rule 11 be filed?
The trial court can exercise the power under Order 7 Rule 11 CPC at any stage of the suit—before registering the plaint or after issuing summons to the defendant at any time before the conclusion of the trial.
On what grounds plaint can be rejected?
Upon filing a civil suit or a commercial suit, a court can reject the plaint on satisfaction of grounds listed under Order 7 Rule 11 of the Code. These include under-valuing of claim, insufficient stamping, suit being barred by law etc.
