We get a lot of emails and comments asking about the remarriage rule for VA spousal benefits. Do you lose your VA survivor benefits if you remarry after the Veteran passes?

The general rule is yes -- you do. But there are exceptions to this rule for which you may qualify. And if you're considering remarrying after the death of a Veteran spouse, there are certainly some things you should consider.

Just the marraidge certificate doesn't give you the right to SBP. The SBP is NOT automatic. The SBP could already be granted by court to ex-spouse during the divorced .

So, If widowed spouse of a military retiree, DO NOT re-MARRY! Even if interested in remarrying a (non-career) veteran of Vietnam? So, …Go shack up? Really? A lot of these sites use “veteran” and “retiree” interchangeably, when the two terms are not synonymous, it causes a lot of confusion to us asking questions.

SBP "DOESN'T" always end at the divorced . At the time of divorce if the court granted SBP to the ex- spouse as an ORDERED on the Docunent Relations Ordered ( Military Retirement) Then that ex-spouse will always get the SBP as long as you sent the court ordered to DFAS within 1year of the divorced. The veteran can be re marriage as many times as he like, nothing will change the court ordered of SBP. That's mean new wife got nothing.

My fathers new “wife” (she never legally remarried as she gets her deceased husbands military benefits) because they aren’t legally married, but in a committed relationship, is that against the law?

Question? I’m considering marrying a retired officer. I am curious to know he was divorced years ago but I we were to get married will I get any benefits? If so, which ones? He’s retired already and I’m 10 years younger so he wants me to retire too which would mean if I do I would not qualify for my own retirement. Is this a smart decision to join him I. Retirement or should we just marry and I try my hand at the lottery?

Happy new year n thank you for all information but I will like for you to do a. Video on common. law marriage I was involved for more than 30 yrs which is my case n I finally got married with him but he was diagnosed with slavery gland cancer but pass away 3mts after we got marriage .And every where I have been told that I don't qualify for spousal benefits he pass last yr n I have been denied any help gr VSO officers to organizations who told me I don't qualify for anything n wouldn't give me time a day to fill forms very frustrated.

i lost my foreign veteran husband in June 2021 from a service-related cause of death and I am now receiving a DIC benefit. I am turning 62 year old this year and I intend to remarry. I wanna confirm after watching the video whether I can keep my benefits even I remarry. Thank you for your guidance.

Nothing to be surprised when you don't get the SBP. First Ask yourself did you enrolled into the SBP? ( Not automatic ). Did the court granted the SBP to you during the divorced? Did you paid the SBP insurance out of your portion of retirement after divorced?. If none of these then SBP is NOT yours.

What happens if the surviving of a passed away veteran is receiving benefits (DCI)
and while receiving the DCI she gets marry again? Will she loose the DCI benefits?
Question number 2: I am the veteran. What benefits my wife is entitled or eligible
to receive now?

I need help because they denied me because I didn't stay with my husband but my husband like I said on one of my other comment he broke my Jaws 2 years after marriage and I left with my kids I had kids before I married him and I left for my my safety and my kids safety he even pulled the gun on my son at 14 years old so we had to get out of there so now that he said I apply for DRC and pensions and I got denied I want to know what's the next step

What if he has ex wife that receives his survivor benefits from military retirement and it’s in her divorce papers it’s hers forever

What if it says no SBP does it mean 0 benefits pension and disability or no benefits at all to the surviving spouse? Thank you for answering this..
