Social Security defines the word “disability” in terms of how your medical problems prevent you from working. Therefore, if you are able to work, you are not disabled under this definition and most of the time SSA will not even take an application from you,

If you are working part time, SSA may or may not take a disability application - so as a rule you want to be able to say that you are not working when you apply for disability.

If you do decide to try to work while your disability application is pending, make sure to discuss with your attorney the differences between an unsuccessful work attempt and a successful return to work that counts as substantial gainful activity.

So what if I live alone? Widow. No other money coming in. I work 3 jobs to pay my bills now, all part time. How the hell do I pay my bills? Guess those of us that have this issue are screwed? Pretty ridiculous. Are we supposed to become homeless as well as disabled before they will even hear a case?

I would like to possibly refer cases to you. I have a client now with listing level HIV [20 T-cells] not real compliant with taking her medication and is working over SGA, but she should not be working. What can be done?

good afternoon I wanted to ask you a question so I've been working at my job for 7 months as a hostess and bussing tables. I really do have a disability I had really bad carpal tunnel and it started about a month ago and also I have anxiety I'm on medication bipolar and depression and trauma. I recently cut my hours to eight hours a week literally on Friday I talk to the general manager due to my carpal tunnel pain and the other issues that I'm having plus I have a 19 month year old little boy that's not walking yet and he's in a lot of therapy. in your opinion could I get disability or should I just stopped working what should I do

Hi Jonathan, emailed you in the past, and I appreciate your advice. Just one thought, you said in this video that the process has slowed down, and it may take several years to get ssdi, but If you meet one of the listings, would that time frame still hold true? I have Spinal Stenosis, and I must work one more year to meet the 20/40 rule, then everything will be met for me to apply. Thanks once again for your great videos and for being so nice in giving your advice. Gary.

I'm working part time while waiting for my hearing, but my employer filled out a work activity form that showed several accommodations they make for me and also that I am working at 60% of the capacity of a normal worker. Will that help?

do you have copies on your website that shows examples of a checklist form you send to treating doctors for meeting a listing i cant find one?

would like to know listing 12.15 is that under post tramatic stress or is 12.06 ? i saw a video that if you filed your ssdi claim before march 27th of 2017 the judge has to use the treating doctors opinion as controlling weight but if you filed after march 27 2017 i read the ssa rule do you agree that is correct could you do a video supporting this?
