DEAN WINS, GIBSON LOSES??

Guitars of the Day! Taking a look at... WAIT holupaminute?? The 5th Circuit Court of Appeals just completely reversed Gibson's trademark victory over Dean. The Dean V and Z live on, at least for now. Wild stuff, this could be massive for the industry at large if Dean manages to prove the V and Explorer shapes are legally "generic".

I thought the point of trademark is that if you don't legally protect it, it disappears. You don't have a protected trademark if somebody else has been using it for 40 years.
