Is It Better to SETTLE YOUR CASE or GO TO TRIAL?
NY Medical Malpractice & Personal Injury Lawyer Gerry Oginski Explains
516-487-8207

You sued your doctor.
For medical malpractice.
For causing you harm.
Permanent harm and injury.

Your doctor denies he did anything wrong.
He denies anything he did caused you harm.
He also claims that your injuries aren't really that bad.

You spend two years litigating your case.
It's torture for you.
It's frustrating.
You know in your heart of hearts that you're right.
You know that your case is just.

You want the doctor to accept responsibility.
You want him to acknowledge that he shouldn't have done what he did.
You just want him to apologize and turn back time.
You want him to make it right.
But he won't.

Now, you're committed to moving forward with your case.
As your case is approaching a trial, you wonder if it's better to settle your case or turn down the defense's offer and go to trial.

Gerry I love your enthusiasm and care for your clients. You truly take pride in being a lawyer and it shows. Thank you for the education as I have been following you since I got in a 70mph care crash last Thanksgiving in 2022. I appreciate all your wisdom.

Thank you, Lawyer Oginski, for your guidance for the settlement.

Another thing I would think should also be considered is the extra cost required to go to trail. After all what gets awarded is not what a client walks away with once you factor in different costs. Even if a jury awards you more in a trial if the added cost is more significant you still might not walk away with more.... But again as you stated it depends.

4:58 If the value of an injury is more or less known why do cases take years and years to settle?

Hi is it normal for the court to push the pretrial every month for over a year now.

Your Lawyer already spent thousands of dollars of his own money on your malpractice case. If you don’t want to settle you may get nothing! and your attorney is out all that money!! So settle if offer is reasonable.

Roughly how long after deposition does it take a case go to mediation? Will this be based on the readiness of the attorneys? My wife has a tough time during the deposition by reliving her injuries with all that pain and suffering.

a jury that wants to get home or feel a big award will raise medical care cost for everyone else. Was it extreme negligence or a Opps mistake.

I want to settle $80, 000 my lawyer wants to go to court jury trial I don’t. I’m happy with that decision I can’t win I have history with accidents. Can I ask my lawyer to take the settlement?

Quick question. My former employer offered $15k before summary judgement filing. I declined and my attorney told me that I could be found responsible for the defenses deposition costs and other fees. I have sufficient evidence to support my claims; can I still be held responsible for these fees if I lose summary judgment? Thank you for your time.

This is not a medical injury-related issue but a wounded-narcissist based one.

I have a family member, who started a frivolous lawsuit against me in an attempt to bully me/extort money/force me to give up control of my life to them, but unlike they expected me to do, I lawyered up and called his bluff.

His first lawyer told him to give it up and do mediation and sign over the land that I have developed and been on for decades(plus other things) because his own, plus bank and other records show that I paid for it years ago. He refused, then doubled down on harassing me only to get caught on camera doing that plus taking stuff from my property.

He's now on to his second lawyer and all they do now is lie about everything and waste my time and money having to refute all the nonsensical claims they are throwing at me now. What bothers me is that every time we end up in the courtroom his side drags things so far off-topic that my side has no clue what to say to do about anything because he/they just makes up stuff on the spot and run with it.

It sounds convincing (If you don't know the whole backstory behind everything is just pure fabrication based on tiny bit of irrelevant reality) and I clearly have no replies or evidence to counter any of it and the judge seems to just let them run with it. As of the last go around he has requested a trial by jury which makes no rational sense given he has to date not brought any of the supposed mountains of evidence he claims to have on me (Because it is all made up and does not exist, or does not show what he claims it does).

What do I do with this? I have literally hundreds of pages of documentation from loads of credible sources, bank records, legal records, law enforcement, local/state/federal regulatory agencies, and so on plus hours of videos of him stealing from me, harassing me and my friends and more, yet every time in court the judge seems to care less about looking at any of it.

Whos getting set up to get cooked here? Me or him? Right now it feels a lot like me.
