World reacts to ICC prosecutor seeking Israel, Hamas arrest warrants

China has said it hopes the International Criminal Court will maintain an objective position, after its decision to apply for arrest warrants for top Hamas and Israeli officials. Both sides have been accused of war crimes and crimes against humanity. Israel and Hamas have dismissed the ICC prosecutor's accusations. Italy has criticised the ICC, saying it is unacceptable to put Israel and Hamas on the same level. However, France has deviated from its Western allies, saying it supports the independence of the ICC. Sarah Coates reports from Tel Aviv.

The French Ministry of Foreign Affairs issued a statement on the evening of May 20, stating that "France supports the International Criminal Court and its independence and supports the fight against impunity under all circumstances."

The statement also said that France has been warning for months about the need to strictly abide by international humanitarian law, "especially in the Gaza Strip, where the number of civilian casualties is unacceptable and humanitarian aid is lacking."

ICC should have avoided the obvious procedural defect of not following up on "complementarity" provided for on ICC code, ie., it should have waited to see what the domestic judiciary of Israel would do on the charges, if any. It should have made recommendations accordingly. Not doing so means this case suffers both from procedural defects and partisanship.
