Which party was harmed here?
Two institutions, did their 'due diligence, ' didn't like what they saw, and declined to do business with Trump.
Other institutions, apparently, did their 'due diligence' and decided to to business with Trump.'
The institutions that DID business with Trump: went into the deal with eyes wide open, were paid back and, said institutions were willing to do business with Trump again.

I'm a 'layperson, ' I drive a truck- I don't practice law. But it seems to me, that when bringing fraud charges, there HAS to be a damaged party. There was no damaged party here, according to the states' appellate lawyer but, there was the POTENTIAL to damage a party...and she seems to suggest that the STATE can step in when there is PERCEIVED damage, based on the STATES' interpretation of value.

It appears to me that the New York Attorney General's fraud case is dead in the water, if not at the appellate level, then at the US Supreme Court .
