Netanyahu and his cabinet is not protected simply because Israel is not a signatory to the ICJ. The crimes were committed in a jurisdiction that is a member of the ICJ. while Israel may provide protection for those indicted or subpoenaed for war crimes however should any of those with warrants go to a country whom is a signatory they must be arrested in accordance with the ICJ pact. Once Netanyahu leaves office he will become a fugitive in most western countries and subject to those warrants. This is how I understand how the system works.
