An innocent man is suing the Marion Police Department in South Carolina after being pulled over, held at gunpoint, and handcuffed in November 2022. The lawyer representing David Wiggins said his client was on his way home from Burger King when he was mistakenly pulled over and detained by officers searching for a different driver. The Law&Crime Network’s Sierra Gillespie breaks down the bodycam footage and lawsuit with Wiggins’ attorney, Marvin Pendarvis.

Why did they not run the plates and properly identify them before making a felony stop? It seemed like she used the “did you run from me” as an excuse to stop him to justify a mistake. I’m glad he is filling a lawsuit because something seems fucky.

I'm surprised the cops didn't accuse the guy of resisting arrest and obstruction and say his windows were too dark and they smelled marijuana in his car.

Imagine not too long ago when there weren't cameras recording everything. These cops got away with this type of thing on a daily basis for decades.

That guy did everything right when handling himself in that situation, despite the immense amount of pressure and anxiety he was going through. It's an absolute travesty he was put into that position in the first place and I hope he gets an outcome from this lawsuit in his favor and is able to use this incident as a teaching moment, towards other police departments to ensure this does not happen again. Wishing him a speedy recovery from this mental trauma.

The biggest problem I have with this video is, wen he asked why is he being arrested, and she responds with a question. That is not how that goes. Especially with a compliant individual. It could be interpreted as a violation of his rights if she didn’t know if he ran wen she asked that. You can’t pull over any challengers over a hunch.

It’s so dehumanizing for another human being to place you on the ground like an animal while threatening to take your life. Detain someone, check for weapons, without psychologically damaging them and humiliating them.
