Proving pay discrimination first involves finding a comparator, one or more people of the opposite sex who are paid more for performing the same type of work as the plaintiff. Importantly, comparators are usually limited to people employed in the same establishment. Pay comparisons across companies—or even among personnel in different divisions, offices, or plants of the same company—usually will not suffice.
