This video leaves out the biggest smoking gun which was that the firing was retaliatory. She had complained to HR about another employee who made racist comments towards her, then,
all of a sudden after she complains about him, she gets fired for “tardiness“ despite never having been warned or disciplined for lateness before, and in fact the man who she complained about had been tardy more times than she was, which is where disparative impact comes in. It was obvious that Equinox just fired her because they didn’t want to deal with investigating the allegedly racist employee.

For a bit of background, the CBS article about the lawsuit says
"The trial included "swipe-in data" from other Equinox workers that showed that other managers had worse time and attendance records than Europe, although she was the only worker who was disciplined, her attorney stated."

The real issue here is another employee harassed her by making sexist and racist comments. Europe informed Equinox what was happening and they did nothing. Instead of firing the employee making the comments, they fired Europe using the “late” excuse.

Yeah, when you sue for ridiculous sums, it's not to be greedy. It's to actually make the company think twice about doing this again.

Equinox is an awful company. I was descriminated against them when I was seeking employment years ago. Very elitist.

I work in a company that uses 'punishment points' if you are late.
Get 6 points and you are fired. If you are 1 minute late its 1/4 point.
I was 30 seconds late once in the last three years. Points are issued by managers who are exempt from punishment points and are often late or take half days off on fridays.

I'd love to hear more context on this if you could. They decided she was discriminated against because of race but the short story really only talks about her being late 45 times. What did they do to discriminate? Spill the tea 😁 I love when companies get ousted like this

If you think such large sums of money are ridiculous you should understand that stress causes health problems. In my early 20s I bought into a lot of FOX News talking points. Over the years I've talked to others, faced my own struggles as a gay working class man, listened to NPR, and read books and articles from the other side. I now know that racial harassment and discrimination in the workplace does more damage than just a person losing their job. You may find yourself as a minority in a society, not sure if you should speak up at every little thing or save your energy. When you get a new job you don't know what kind of jerks will be working with you and how well liked they are. The stress will probably kill you early. $11.25 million is fair and could save her a couple decades where she doesn't have to worry about her work environment.

I just saw this but they clipped it. They didn't mention nothing about her race. They only showed that she was fired because she was late 47 times and now they own her money but I knew there was something more to just that. I'm glad you brought this up.

This is one reason why having clearly written policies are important. Such as if you are late three times within 6 months you are suspended for 3 days if you are late three more times after that again within 6 months you are terminated. A policy such as that would have save the company millions. The key is that the rule MUST be enforced across the board No exceptions.

I’m sick of it. Sometimes I just want to delete myself. It’s unfair while others get to work for their families. I’ve experienced this my whole life. I’ve done everything from not being late, not calling off…to minding my business. Cali is the new 🇲🇽
