Forced arbitration should be flat out illegal. I think companies should always be held liable when they screw up, especially when they screw up really bad. They always want to tell you to take responsibility for your actions but they don't want to do the same thing.

Fun fact, because this doesn't allow for any class action, and because arbitration costs are higher for the company than for the customer, if everyone who agreed to this was willing to pay the $50 filing fee for arbitration Discord would be forced to pay $250 for each arbitration they respond to, and if they don't respond they are defaulted against. Get 10000 people to do it at once and that's 2.5 million in arbitration costs that they must pay or else they lose all of them by default, and few companies have 2.5M in cash just sitting around. Not to mention enough lawyers to cover all 10000 suits. And since the contract specifically says no class action, period, courts have held that the company cannot try to merge the arbitrations together.

the site is not selling all your chat history, it is basically a bot disguised as a normal user that gets invited to public servers and harvests the data. nothing for sale here is anything private, tho the ethics of this are still questionable

Guys it’s not that big of a deal. It’s not a breach. It’s just a bit recording PUBLIC messages in LARGE PUBLIC SERVERS. No hacking your DMs or finding your small server, just big servers. Be careful what you say

That's a misuse of the term "data breach." Discord wasn't hacked. The data was scraped by a bot.
