A presumption of innocence means that any defendant in a criminal trial is assumed to be innocent until they have been proven guilty. As such, a prosecutor is required to prove beyond a reasonable doubt that the person committed the crime if that person is to be convicted. To do so, proof must be shown for every single element of a crime..

Hate speech is that speech which serves to deny equal standing under the law to an individual or group on the basis of racial, gender or religious identity in order to deny rights, impose obligations or prevent legal due process. Note that this makes much of religion hate speech, particularly the whole of Islam, as well as the policies and notions as expressed by today's US Republican party.
