If the audience was specifically told not to before they walked onto this soundstage then Whoopi was in the right. But if not, then she’s out of line. Wait to commercial break to walk over to him and quietly let him know it’s not allowed.

When you sign on to be in the audience it says in bold do not record. Have a difference in opinion, but the rules are rules. He is lucky he isn’t getting sued
