My understanding is that when a car is being repossessed, it is no longer owned by the person being repo'd from. The bank/dealer, etc now owns it. So any damage the car causes is the responsibility of the owner. This previous owner, however illegally hopped in the car and dove it off the tow truck. So he should be responsible for all damages.

I remember years ago, I had a neighbor that didn't pay her bills on time and she would constantly get collection phone calls and she would literally rip these people apart for daring to ask for their money. She was so good at it that by the time she was done, you kind of believed that she was the victim. People who do that stuff don't have an ounce of humility. This guy should have walked away and said hey, I should have made my car payment instead of pretending he's the victim

Most people don't realize that when a car is repossessed, that's not the end of it. The lender auctions off the car (they usually get half of the car's value), put that towards the balance owed, and you're still responsible for the rest.
