Unemployment benefits is an insurance scam by the government. Employers and employees pay in through taxes. Employers through unemployment insurance and the employee through Medicare and state withheld taxes even though employers are convinced that ONLY they pay in.

Veterans and the lower class are abused the most by unemployment. Higher risk employees pay in the SAME amount as a low risk employee. That's not how insurance works. If there is MORE money in unemployment. There is more money on the government's pocket.

Its disgusting.

My last employer is making HORRIBLE accusations of me. This video made me want to fight them even more. I really appreciated it.

Although this video was based off of Illinois, I found it very informative and hope that information I've learned here will help me prevail in my VS employer case here in Ohio.

Understand the whole process of filing a claim, local office determination, appeal, and final review by the circuit court.
Understand the legal term of misconduct, which can lead to the denial of unemployment benefits.
Understand voluntary leaving and whether it is attributable to the employer or the employee.
Prepare clients and witnesses for the hearing, rehearse testimony, and convince the referee that the employee was terminated for reasons other than misconduct.
Present exhibits, submit them to the referee and the other side in advance of the hearing, and get them lined up in advance.
Research cases on point for your fact pattern, find cases in the Illinois unemployment handbook and the digest of adjudicated precedents.
Have witnesses available on the phone, identify them in advance, and make sure they are well-prepared to testify.
Present witnesses smoothly and without interruption to win an unemployment compensation hearing.
Make sure to cross-examine witnesses regarding explicit warnings or lack thereof, harm to the employer, and hearsay evidence.
Get your positions on the record, cite relevant cases, and make objections as necessary.

I applied for UI 5 months ago and after waiting that long I found out the employer has denied the claim! this is awful! The law should change, if employer fries, employer should pay for it!

I left my job but I felt like I was forced out because I was being targeted. I hope that doesn't fall under voluntary leave. Thanks for this video it was very informative.

I filed in June and have been receiving payments from June 14th, however I have not been able to get through to TWC and they never sent me the DUA packet that they claim they will send. Furthermore, upon leaving a request for call back and getting the call back one week later, I was told that even though I am eligable to receive DUA assistance, I was denied my back pay because I didnt file for the ui until June. A friend filed for exactly the same thing with almost identical circumstances and she filed 2 weeks after I did, and she is getting $11, 000 in about 5 days?? Can they arbitrarily decide who gets it and who wont even with identical situations? I could lose my lease due to lack of income, which I lost a huge contract (self employed) as a result of covid-19. I filed an appeal and now the appeal wont even post for another 3 weeks. We could be on the streets by then. Is this even legal in Texas, arbitrary case denials?

I had a hearing with my job and the referee and the employer clearly said in the hearing that i was not fired for mis conduct and but the referee still ruled it as misconduct.

I left my job due to really bad equipment. I also took video footage and have pre trip documentation of it. I figure they will still fight me on it. It was a union job but the union representative and I both said they would retaliate in some form so it was best to just part ways.

I was not let into my work. Long term facility facility. Answering the corona virus check list.
Every other day I had answered yes or no.

Finally still coughing under a doctors care facility shut me out.

Now we’re told by our Governer to stay home.

a my job . They had put me into unpaid leave . After having my doctors letters . They sent me the letter .

How many times can an employer an appeal.1st they appealed the initial clam than i appealed that decision.Now they have appealed that decision 6 months later.They never appeared for my appeal knowing they would either win or have to appeal again.So question how many times can the decision be appealed.Seems the courts favor employers becuase of their experience and its singling out employees as individuals based on previous claims .if not for cov2 quarantees and the UI dept shutting down I would not be in this mess.I thought i was done with it but now 6 months later its causing me grief again.

So I was terminated for leaving work early due to a family emergency without notifying anyone couple months back. I was given a written warning about this which I violated a couple days prior to the incident. At the time my senior project manager was on vacation and all of my principals were extremely busy at meetings. My role was a junior Project Manager and the person that "snitched" on me was essentially my underlings. She told my principal in person that I left without any notice to her and did not leave any tasks for her to do for the rest of the day. This was a lie as I left numerous tasks for her to do which she did not need any of my assistance to do as she already had the skills and knowledge to do so. So my question is; am I basically screwed for signing the written warning or do I have atleast some chance to win especially if the employer doesn't show up for the hearing? Just want to know if I should waste my time pursuing this or not.

I left my work because the employer was committed a misconduct. I presented my case and the referee denied my claim saying I should’ve secure another job before leaving. Is that valid?
