I am an electrical contractor. I worked for an electrical contractor. I left him and started my own business. I used my cell phone to communicate with the customers. When I left because my pay was crap as time would pass a bunch of the old customers started calling me directly. When you make someone the face of your business that sort of thing will happen.

And there's NOTHING that says a customer HAS to buy from you so there's NOTHING that will prevent that.

I disagree with Dave, but what the company does own is the customer information. So, if a salesperson leaves, they have to collect customer contact info from public sources. A while they can announce leaving your business and that they are starting a business, they cannot state the new business name, contact, info, or even solicit.

Capitalism is about competition. The fact that there is anything on the book to directly control corporate competition shouldn't be allowed. Whether it be customers or such. The only thing I agree with is contracts that state " you will not disclose, or use the exact same formula or systems from this buinesses anywhere else." Which means you can't copy the brain child that is How somone else operates their businesses in the day to day, such as POS systems and/or practices or specific bennifits or such they use.

However the customer has a right to not only choose, but to be marketed to in any way possible. If I can't market or try to sway a customer to use my service then the idea of a free system that's built on healthy competition completely collapses and then the one getting screwed at the end is not only the customer, but buinesses as well.

One time my husband was threatened by a lawn company because we (unknowingly) decided to go with a company that was an ex employee who built his own business. They threatened to sue my husband if we used the other company 😂😅 horrible business practice!

A contract like that is more ridiculous than a non compete. I’d love to hear the court case where you tell a jury you own sole access to a customer.

If your sending them out there and they are stealing clients you have something fundamentally wrong with your business making them want to leave and do it themself

How about doing a better job for your customers. Only reason the competition is even there is because you clearly aren’t doing a good job keeping the customer on your books.. don’t blame your competition, that’s what losers do.. find out what the customer is being offer and make your offer better..

I don’t have context outside of this short but generally I feel like if you can’t keep any employees and they keep leaving and starting their own business that’s on you. A lot of people don’t want to be their own boss and if you treat them well and pay them right that’s much rather have the stability of keeping their job working for someone else as opposed to the risks of becoming a business owner

Clearly, these employees are looking at the risk/reward of going off on their own with these customers. The simplest way to keep these employees and customers is to affect that calculation. You can't really affect risk, but you can affect reward by improving their compensation. If this keeps happening, it's pretty clear the problem is her or how she's compensating.
