Brian literally broke down the case, and rebutted everything the prosecution was going to throw at them during the opening statement. Instead of defending, that man went on attack. During the case itself he is not allowed to "testify", but he did it during the opening statement - it's technically not evidence, but it will stay with the jury. Great strategy.

"Prosecutorial Misconduct" refers to the unethical or illegal tactics by "Prosecutors" in a criminal case, such as: withholding exculpatory evidence from the defense, making false statements, or. presenting inadmissible evidence to the jury, offering evidence they know to be false or inadmissible (including encouraging witnesses to lie on the stand), and not limited to using improper arguments.
This (Alleged RICO case) is a direct example of "Abuse of Authority" fueled by District Attorney (Fani Willis) in hopes of some sort of Political gain/Popularity Contest.
