The judge absolutely did not find that prosecutors did not act in bad faith or excuse their behavior by saying they were swamped. The conclusion in this piece misses the entire point of what happened in court. The judge saw exactly how badly these prosecutors have disregarded discovery rules and basically warned them, that one more violation, and their evidence would be excluded.
