Bianchi v. Brown, Maryland Assault Weapons 2013 Law 4th Circuit Court of Appeals

Covered weapons:
The statute defines “assault weapon” as “(1) an assault long gun; (2) an assault pistol; or (3) a copycat weapon.” Id. § 4-301(d). The term “assault long gun,” in turn, encompasses more than forty-five enumerated long guns “or their copies, regardless of which company produced and manufactured” the firearm. § 4-301(b); see Md. Code, Pub. Safety § 5-101(r)(2). These proscribed guns include an assortment of military-style rifles and shotguns capable of semiautomatic fire, such as the AK-47, almost all models of the AR-15, the SPAS-12, and the Barrett .50 caliber sniper rifle. See Md. Code, Pub. Safety § 5-101(r)(2). The term “assault pistol” encompasses more than fifteen enumerated firearms and their copies. These include the TEC-9 and semiautomatic variants of the MAC-10, MP5K, UZI, and other military-style submachine guns. Md. Code, Crim. Law § 4-301(c).

(i) a semiautomatic centerfire rifle that can accept a detachable magazine and has any two of the following: 1. a folding stock; 2. a grenade launcher or flare launcher; or 3. a flash suppressor; (ii) a semiautomatic centerfire rifle that has a fixed magazine with the capacity to accept more than 10 rounds; (iii) a semiautomatic centerfire rifle that has an overall length of less than 29 inches; (iv) a semiautomatic pistol with a fixed magazine that can accept more than 10 rounds; (v) a semiautomatic shotgun that has a folding stock; or (vi) a shotgun with a revolving cylinder.

Military style weapons are constitutionally protected arms. It's in the part where we have the right to form a well-regulated militia. A militia is a group of civilian war fighters. Militia members have historically brought their personally owned firearms to muster. To be effective as a group of civilian war fighters, they require the ability to arm themselves in a military manner.

SCOTUS take notice; US law enforcement agencies have found and demonstrated that the semi-auto AR-15 is an excellant defensive weapon. The appeals court has lost its focus, the 2dA was not primarily about having the minimal weapons needed for personal defense but about being ready for collective defense of community using personally owned effective military capable weapons. Civilians have been hunting, target shooting and defending themselves with semi-auto rifles for more than a century. If the M-16/M-4 has about the same useful military capabilities as semi-auto rifles as implied by the appeals court, take the M-16/M-4 off the NFA. Criminals can kill people rapidly using most manually operated firearms when the victims are all unarmed in "gun free" zones. Are the political descendants of Red Coats plotting to return to "Lexington and Concord" to seize civilian weapons?

i will always fall back to my point that since the original 2A was against the threat of a tyrranical government, then tyrrany in general, and subsequently self defense. And that those engaged in illegal activities are not covered with or without guns, but with the caviat that under a tyrranical government anyone exercising their legitimate 2A rights would be a criminal by default under their tyrrany. Simply put "The people should have access to, and be as well or better armed as the government itself." So when Ol' Joe says the military has F-15's and tanks...I didn't stutter.

FPC needs to use the gun grabber language against them. Heller says you cannot ban an entire class of arms commonly chosen by the public. "Assault Weapons" are an entire class or arms that constitute 90% of the arms chosen by the public. So they cannot be banned. Just as well, we have no history of the government regulating the rate of fire of lawfully owned firearms.

As an Illinois resident I am very interested in what happens in respect to those "15" styles of long ARms.
