Even this case aside (though this certainly exemplifies the need), something needs to be done to mitigate state and federal judicial systems’ filing of lawsuits that do not hold up in higher courts. At bare minimum, they should be held responsible for defendants’ attorney fees on cases overturned/lost upon appeal/retrial.

The Supreme Court was right to leave the question of "what are official acts" vague. That's how higher courts work. They don't rule on questions which have not been decided on by lower courts.

In this case, lower courts need to interpret "official acts" for themselves, then those questions will end up back with SCOTUS. I question this guy's legal expertise. And it was always a huge stretch to think this would be adjudicated before the election.

There is a reason why the Supreme Court ruled that his intent doesn't matter, and that reason is because you wouldn't be able to prove his intent anyway. Intent is a state of mind, it does not leave much in the way of physical evidence. Unless you luck out and someone outright states their intentions, you simply can't demonstrate what they are, especially if you are trying to prove they are not what has been stated.
