The first legislation covering copyrights enacted in India was the Indian Copyrights Act, 1914, which substantially applied the English Copyright Act 1911.
The 1914 Act continued to operate even after independence till the passing of the Copyright Act 1957, which came into force on January 21, 1958. The current regulatory framework governing copyright includes the Copyright Act 1957 (the Act) and the Copyright Rules, 2013 (the Rules).
The objective of copyright law is to encourage authors, composers, artists, etc. to create original works by giving them incentive in the form of exclusive rights granted by the copyright. As with all intellectual property laws, the objective of copyright law is to achieve a balance between monopolistic claims and adequate protection to intellectual property to encourage creative and inventive thought.
Copyright is a unique kind of property. Just as other intellectual property, you cannot touch and feel it like house and cars. But what you can protect is the creation of the mind by prohibiting others from ‘copying’ your work or the creation of your mind. Thus, ‘copyright’, or at least the literal translation of the word, is essentially the ‘exclusive right to make copies of your own work’ in all manners and forms and not works of others.
