Roe v. Wade overturned: What it means for North Carolina and South Carolina

The Supreme Court ruled to overturn Roe v. Wade Friday, the longtime legal precedent guaranteeing the right of legal abortion in the U.S. The landmark ruling now puts abortion into individual states' hands.

This prompts immediate questions across the country about what's next for abortion rights. So where do the Carolinas stand on the issue?

Trigger Laws
First, neither North Carolina nor South Carolina have so-called "trigger" laws regarding abortion.

When it comes to abortion, more than a dozen states have trigger laws that will immediately take effect and ban abortion following the Supreme Court's ruling on Roe v. Wade. Those states include neighboring Tennessee.

SCOTUS did not impose a national ban on abortion. They tossed the issue back down to YOU, the voters of a legislative body with the powers to make laws. Fifty years ago, it was wrong for SCOTUS to decide on abortion, when SCOTUS is limited to the Constitution and intent of Congress at the time of amendment.

I think that maybe people will sit down and make birth control plans, there are plenty. Planned parenthood’s first goal shouldn’t be abortion, it should be heath of patient, and birth control. Explaining the different kinds and pros and cons. I remember when I was pregnant with my 2nd child, we didn’t have much money. I needed to go through the health department to get Medicaid to help. First thing that happened was I was pulled into a conference room with a counselor. She was basically talking to me about did I really want my baby, could I afford…these places for women I’m not against, they need reproductive help…education…if they had that they wouldn’t be getting into positions of being pregnant and talked into an abortion. I am very thankful that this has been overturned. It is 2022 and we have many many options beside abortions. This is just a political move and they have people brainwashed.

A fetal heartbeat may first be detected by a vaginal ultrasound as early as 5 1/2 to 6 weeks after gestation. So with that law in effect: You have 20 weeks in SC to get your help with a clinic for the abortion process. HOWEVER: 6 weeks is also only 42 days. Which means you have less than 2 months to get an abortion in SC; or you go to jail once you do.
