Buying a Machine Gun with a C&R License

I am often asked how a C&R license (Curio & Relic, also called a Type 03 Federal Firearms License; not to be confused with "Class 3") affects the purchase of a machine gun. So, I put the question to John Keene, NFA specialist for the Morphy Auction Company...

The short version is that a C&R license does not allow you to skip the NFA transfer process. You still must submit fingerprints and photographs, and wait 6-9 months for your tax stamp to be processed. Once it is approved, however, a C&R eligible machine gun can be shipped interstate to you, without having to go through an NFA dealer in your state.

Seeing the look on Ian's face when he mentioned the chateleroux means that we will be seeing a video on one in a few days or weeks

When I got my C&R license a while back, ATF sent me a book with a listing of C&R guns presumably that don't necessarily meet the 50 year mark. Section 3 is titled "Weapons removed from the National Firearms Act as collector's items which are determined to be Curios or Relics subject to the provisions of the GCA"
Is the process any different for these? I've seen plenty of SBRs in that list.

I finally picked up my suppressor in May, took 11 months and 4 days.

I feel like all pre-86 machineguns should be C&R since their value comes from their rarity

Ian: Babe, do the thing I like with your mouth.

If you're going to go that route, Ian, just get the 37mm Maxim. It's for the children. The children who want to shoot down Zeppelins.

I think Ian might have just gotten a new machine gun quite recently

apparently the word “infringed” has no meaning.

a centimeter and a mile are equal distance when it comes to the word “infringe”. 🇺🇸

Atf knows how to complicate infringements and pricey too

John is a great guy to work with. Why not go out with the dealer possessing your firearm and get to shooting it before the 10 months? Sharing is a wonderful way to go through life.

Great video. As a C&R holder I was actually curious how this worked. Thanks.

Step One: Acquire currency.
Step Two: Machinegun.

If congress will withhold funding from states that done accept certain federal rules, why not withhold funding for those that don't observe the 2A? (which would negate the need for the NFA, but one step at a time)

My first NFA purchase on my C&R license was a Steyr-Solothurn MP30 subgun (the police model of the MP34 Ian did the video on). It was shipped directly to me - as in UPS left the package with the gun in it laying on my porch in front of my front door in plain sight of anyone passing by. I thank God there weren't any porch-pirates around then. BE CAREFUL WITH THE SHIPPING!!!

It was nice getting a C&R MP40 sent directly to me; although it took a year luckily it came just in time for my birthday last year.

Ian, nice video describing how an individual with a C&R can receive a 'vintage machine gun'. Now that NFA Trusts are widely popular, I was PRAYING that there would be discussion with John if it is possible for a NFA trust to directly receive a C&R machine gun when a trustee of the trust is a C&R FFL holder, and he also signs the Form 4 on behalf of the Trust as trustee for the trust. Request your comments or maybe "Machine Guns and the C&R License Part Deux"? Thank you.
