The public intoxication law has always made no senses when restaurants sell alcohol and sometimes have outdoor seating

Here’s some explanation from a legal perspective:

The brown bag is required for _alcohol, _ but you can technically put _anything_ into a paper bag. By concealing it from public view, you’re removing probable cause for an officer to ticket you. Obviously we _know_ it’s alcohol, but the courts focus on the letter of the law, so if you can’t tell at a glance that it’s alcohol, there is no crime. The paper bag is a loophole ironically meant to help you. Is it a dumb rule? Absolutely.

Fun fact: In Arizona it is not illegal to drink in public, this is because of the bars and clubs we have that spill onto the streets. However it is illegal if you're drunk and are being a threat to yourself or others and they just throw you in the "Drunk Tank" till you sober up. So we can drink anywhere, except near the pool with glass bottles lol
