WORKERS' COMP SETTLEMENTS

Here are three key things to know about settlements in Nevada workers’ compensation claims:
1) When injured employees complete their medical treatments, the workers’ compensation insurance company will mail them a “notice of intent to close claim.” This notice will indicate whether or not an evaluation is necessary to determine if the worker is entitled to additional benefits.
2) Workers who sustained a permanent injury may be eligible for permanent disability benefits paid out in monthly installments or a lump sum. Workers may also be eligible for vocational rehabilitation services and a maintenance allowance. Alternatively, vocational rehabilitation benefits can be resolved through a lump sum settlement.
3) If an injured worker disagrees with the decision of the insurance company, the worker may be able to file an appeal. And even after the settlement, it may be possible to reopen the workers’ compensation claim if new complications arise from the injury.

Great video with great info! My next appointment is back to my pain management dr because the surgeon didnt recommended surgery. Ive alreay had physical therapy and cortisone shots with my pain management dr. I go back to my pain management dr next month and im going to let my pain management dr know that i no longer want cortisone shots and that i dont feel im physically capable to go back to my position with the company. If they offer me vocational rehab my plan is to deny it and aim towards the lump sum settlement. If i deny vocational rehabilitation, will my bi weekly checks from the insurance company end?

I have a question. My WC case has been going on for over 5 years. Every time they loose in their own WC court they appeal- I injured multiple areas of my back, neck, head and other bones. Since I could only see their ‘approved’ “doctors” I never got a real diagnosis until I got an outside physician of course at the rate of 4 times the normal charges.

Finally they exhausted their appeals and were mandated to pay for the required surgeries. This was mandated in June 2022 and I still wait . Totally unable to live any kind of life with any meaningful outlets because of their baloney I am now permanently disabled. I don’t want to be disabled- I want to go back to my career.

Could this be normal for Nevada WC or is it my lawyer? Can I change lawyers at this point? I’m so frustrated I could just spit nails. However I barely am able to get to the grocery store and when I do I need to sit down in the pharmacy area. I need help and I don’t know if this is normal or if I need new/more experienced representation. WC has boogered up my medical records so bad with their lies that I feel like I’m constantly defending myself- it’s medical gaslighting. I swear I’m definitely at the end of my rope. My lawyer is ‘new’ and does not explain anything to me and this isn’t right - but what can I do?
