Possible talking points for anyone thinking about this:

-Schematics are not trade secrets. They are descriptions of a physical product which is sold to the public.

-Mom and daughter fixing the car story... In fact pretty much the whole comparison that one senator made about cars having “three tiers of repair” vs other things with electronics.

-Lobbyists exaggerate complicated nature of repairs

-Risk of consumers “hurting themselves while or due to repair” is not relevant as that is a matter of personal responsibility.

-Risk of consumers’ products being damaged due to faulty repairs is not relevant as the repairer is ultimately responsible.

-There is a problem (not a solution looking for a problem) + whatever story is most compelling... Many of the legislators have personally experienced the issues with getting repairs done.

-Environmental consequences of not repairing as opposed to the false claims about malicious farmers “hacking their tractors to go faster”

-A bit about tax revenue (not too sure of the details)

-Sloppy incomprehensible comments by lobbyists... “magtrometer”, “turn Mac into PC”, ... lack of answering questions asked by the panels.

-What does ownership mean if you can’t repair?

-Apple data recovery lies...

-Real motivation of companies... “planned obsolescence”/“throw out and buy a new one”... authorized service as a front where repairs aren’t actually done (Apple)

-Security expert testimony (device security is not compromised by repair)... security depends on encryption which is entirely controlled by how the device “writes things down” in memory, not with what components are present.

The example you gave debunking the "safety" concerns of the mom & daughter repairing car brakes vs replacing a battery or resistor was good.

Also - make sure to highlight that schematics are NOT trade secrets, the product is it's own schematic, and it does not compromise encryption or security

Louis, no one seems to be talking directly about the planned obsolescence aspect of the lobbyists arguments.
no one is calling them on the big sham, that it's not about intellectual property, it's about selling a new unit as opposed to repairing an old one. these companies want people to break them, throw them away, and buy a new one EVERY TIME something happens.
point out the climate and "throw away society".

Security Issues pertaining to hardware information:
“Devices with well-planned security initiatives will isolate components that are critical to security within a physically protected and access-controlled areas”. Chips such as Apple’s Secure Enclave and Apple’s T2 Security Chip operates independently of other hardware components, thus protecting their devices with protection against hardware level attacks (#2). This is due to the fact that these “silicon-based hardware root of trust” components are meant to perform limited operations which confine them to only execute static and specific operations: “data encryption, certificate validation, and basic key management” (#3). Apple even states that the “secure boot of Apple devices ensures that the lowest levels of software aren’t tampered with and that only trusted operating system software from Apple loads at startup” (#1). Companies should be ensuring the protection of their intellectual property in a way that protects their data as well as the user’s data even when millions, possibly even billions of devices are in the hands of users today. It is no understatement to say that physical access to a device should not compromise the security of the device as any number of these people could have the knowledge to reverse engineer or hack into the device, rendering privacy useless. This is a deliberate attempt to attack and steal user data or bypass security, not a malicious act from a repairman attempting to figure out why you electronic device is not working the way it is. This means whether or not a device from companies such as Apple, Samsung, Google, Intel based computers, AMD based computers etc. the ability to repair “non-critical and non-security-related components of [a] system” should not impede the security of the intellectual property whom company it may concern (#2). A camera, a touch screen digitizer, a speaker, a battery, and the components which enable these components to function, should not and could not affect any software related security issues a company may have.

A couple of things came to my mind the other day when I watched your testimony in Maine.

- I think it needs to be made clear that Apple has intentionally set up a sham of an authorized service network to further cover up their intentions. I think it would be helpful to go into detail exactly why the Apple repair network is useless.
- I think the legislators also need to know clearly how Apple lies to their customers regarding data recovery. And that they not only lie about it, but even ban users from their company-run website who point this out.
- Make it clear that the lobbyists are intentionally pulling the wool over the legislators' eyes - and that up until you started to appear on the scene they have been able to just get away with it.
- Point out the kind of money that the lobbyists in the room are making to appear and oppose the bill - while you PAY out of your pocket to be there.
- Stay away from terms like "Right To Repair Movement".
- Refer to the CBC News piece.
- Point out how Apple now solders batteries and drives in so that they cannot be serviced.
- Also point out that the manufacturer's goals are short-term (next quarter's earnings) - that this is the main motivation. They want to sell more new units. If their products are truly serviceable, their earnings will decrease. It has NOTHING TO DO with intellectual property or safety.
- Get the legislators' email addresses so WE can all email them directly.

I still say the senator in Washington nailed it about Cars having a 3 tier repair, but Electrics do not. And a Senator from another states personal response may weigh heavier with other senators

Hi Louis, here are a few notes:
Right to Repair - Bill of Rights
1. Right to choose who will repair based on
personal choice outside of "expensive"
authorized monopolized dealers ( like Cars )
2. Right to have free access to component diagrams with parts and part numbers.
3. Right to be able to buy from parts suppliers directly.
4. Right to not have manufacturers intentionally glue or solder parts to prevent simple repairs.

5. Right to not be bullied and scared by "Dealers" to buying new devices and not fixing them.

Hi, louis. In all testimony the arguement: "Please consider the risk involving batteries", it´s a little bit funny to me because a few years back you can change the battery just removing a back cover and when companies burried it inside wasn't because of a safety issue.
And it was hilarious hear about "the software in the tractors" and "emission issues" and remember Volkswagen with his diesel cars wich had a piece of sofware just to trick the emission test.
Keep going, Louis, you are doing a great job.

Nobody in the 70's expected to send their most expensive consumer item - television - to Sony when it broke. They took it to their local tv repairman. It would have been considered literally insane to suggest to anyone back then that they had to pay 3/4 or even nearly the entire value of the tv for it to be fixed, when a local guy could fix it for a fraction of the cost.
Nobody would have accepted if Sony, RCA or Magnavox had told people "the tubes are bad, so you gotta get a whole new unit!"
Nobody sends their car back to Ford to fix a radiator, nobody expects to have to buy a whole new Chevy if the transmission fails.

Except the auto industry is trying to take a cue from Apple; who has set a precedent for making expensive "non-servicable products". And "our" government is allowing it.
Whose television, car, computer or phone is it? Whose government?

I would say hit harder on the security and piracy threats these companies claim will happen if they let people repair their own stuff. You speak a ton about how consumers don't own their device and how companies charge arms and legs for repair. I would just include a little bit more on how allowing people to order parts and give schematics does not compromise the security in any way. Make sure the senators know repairing a product is not a piracy or copyright issue. People are allowed to be informed on how the devices they own works and functions on the inside.
