Wow, I wished someone would of told me and my friends that growing up, we got questioned so much levelland police department SWORE we stole a tractor and other silly things when we where just kids, we got talked to for hours, never did any of the things they accused of doing and forensics saved us on the tractor incident, they had us in cuffs, but the drunk owner turned out to be the one that stole it and caused a bunch of damage, I wished an adult would of stopped that any of the hundreds of times it happend and tried to help us

That's a lawsuit. I don't even think qualified immunity could defend a good civil rights attorney from bringing this case down the lane for an easy lay up.

He'll beat the charges. The US Supreme Court has already said you can talk to someone under arrest as long as you're not interfering. If a person is cuffed, and isn't being questioned by police at the time, it's not interfering. Have fun with the Federal lawsuit, you're going to win that too.

1983 lawsuit for deprivation of rights.
Strip qualified immunity as freedom of speech is a well established right.
Title 18 USC federal charges on officer for deprivation of rights under color of law and using force to do so. Should get him a year in jail( it wont because lousy federal prosecutors wont actually press charges unless someone gets crippled or dead, because they are corrupt) and a large fine.

I am beginning to think this is they to change. The passive polite way just means a complaint filed and the cop laughs . Pushing the issue makes it necessary for courts to look at the issue and make a line in the sand. Just make sure you are correct and have a back up
