As a server in Vegas, when i was still working at a restaurant that did this, i would always let customers know ahead of time. It's common courtesy to not expect everyone to read every tiny little part of a menu like it's a legal contract.

On my t-shirt, in fine print, it says "Concession discount of 9.85% reduced from all of my checks".

They are doing the exact same things cable and phone companies have done for years, with all their ridiculous made up fees, just to get extra money from you, without having to tell you the real cost up front. There should be a law outlawing this kind of practice, as it’s nothing more than a scam to falsely advertise.
