Attorneys for the man accused of killing four University of Idaho students last fall believe some of the items collected at his family's home during his arrest could ultimately prove his innocence.
Thursday, Bryan Kohberger's attorneys filed a motion to compel discovery, saying they want the court to order prosecutors to turn over materials they requested months ago as part of the standard discovery process.
Defense attorneys say hey have not received body cam and dash cam video from Kohberger's arrest in Pennsylvania.
They also haven't received "copies of lab reports detailing the forensic evidence collection and analysis of items recovered at Bryan Kohberger's parents' home, trash can and other receptacles, and Bryan Kohberger's Hyundai Elantra."
The defense believes these reports could contain exculpatory information, which is information that could clear Kohberger from alleged fault or guilt.
The attorneys did not go into further detail about what they believe those reports contain.
Kohberger was arrested at his parents' home in late December.
He's accused of killing Kaylee Goncalves, Xana Kernodle, Ethan Chapin and Madison Mogen in November.
At the time, Kohberger was a student at nearby Washington State University.
Upon his arrest, investigators said they connected DNA found on a knife sheath at the crime scene, in part, through trash collected from Kohberger's parents' home.
Kohberger's attorneys also say prosecutors have not handed over ISP and FBI forensic lab reports or recordings and notes from Kohberger's interrogation.
Attorneys are preparing for Kohberger's preliminary hearing in June.
At that hearing, prosecutors will need to prove there's enough evidence to put Kohberger on trial.
During a preliminary hearing, attorneys call witnesses and present evidence.
Also, Thursday, the judge in the case vacated a motion hearing that was set for May 25th.
That hearing was on an objection to a gag order in the case, requested by the Goncalves family.
Since that hearing was scheduled, a coalition of journalism organizations (including KXLY) also requested a hearing, hoping to have that gag order revised or lifted.
Because the requests pertain to the same subject matter, the judge wants them to be heard at the same time.
While the May 25th hearing is canceled, the judge set a scheduling conference on the matter for May 22nd.
