The issue wasn't that it was installed with Windows. The issue was that the price of the computer they bought included the cost of a Windows key. Meaning they were forced to pay for a Windows key they didn't want.

People did actually get refunds. That’s how we discovered that manufacturers were paying only around $10 for each copy of Windows when it sold for more than $100 retail. People got between $5-$20 for refunds so it wasn’t worth going through the refund process

Wait, how can an EULA be enforced when you didn't use the software? You are not an End User. You cannot accept an EULA if you do not even start the OS. Did they signed an EULA when they bought the computer? If not, the only "End Users" in this case are the distributors.

This was more of an issue back then because it wasn't far from memory when you'd buy a PC from IBM and you would have options of different operating systems that you would load with a floppy disk. This was well within the capacity of people interested in Linux back then and they understood that. It was only recently that you were forced to use one operating system around the middle of the decade.

This was called the ‘Microsoft Tax’ because you were charged for a windows license whether you wanted it or not. Fortunately many OEMs started offering options to purchase computers without the MS tax due to this movements actions and some like Dell even offered an option to have Linux pre-installed.

Correction: in Italy is mandatory that the manufacturer refund windows license, and it is actually a simple process (because it is mandated by law).

IIRC, Microsoft was preventing the manufacturers from selling machines without an OS, using their pricing negotiations as leverage.

Did you know that Microsoft used to be the largest consumer Unix OS developer? Xenix was really popular as it can run consumer grade PCs in the 80s, before MS pivoted hard towards MSDOS and Windows.

It was said that had Linus Torvalds happened to have bought his x86 PC with Xenix preinstalled he wouldn't have bothered writing Linux.
